Alternative Dispute Resolution (ADR):

Alternative Dispute Resolution (ADR) refers to the several different methods of resolving legal disputes without going to court or litigation. Litigation system of administration of justice is the traditional form of dispute resolution by action through the courts. Over the years, it has become obvious that the administration of justice through regular court or litigation is usually fraught with long delays and associated costs as courts face backlogged of cases some spanning over many years. This is because litigation system of justice administration is adversarial and time consuming and is likely to encourage an adversarial culture and to degenerate into an environment in which the litigation process becomes a battle field where no rules apply.

The importance of banking business in the survival and development of any socio-economic system cannot be overemphasized. Banking basically involves the mobilizing of funds from the surplus units of the economy and lending to the deficit units. Banks are large and complex organizations. Their clients or customers include individuals, companies, institutions, and governments. The relationship between bank and customer is based on contract under which the bank agrees to hold the customer’s money as savings, or to lend its own money to the customer as loan, and

 to render various other services. The contractual relationship gives rise to rights and obligation on each party.

 Banking practice therefore reflects underlying legal principles through which the bank gives the services which the customer expects while safeguarding its own position. It is believed that the legal principles underlying banking in Nigeria will become more complex with the introduction of the cashless policy and four new laws that will tighten the financial sector regulations by the Central Bank of Nigeria (CBN). The bills are the Electronic Transaction Bill, the Financial Ombudsman Bill, the Nigerian International Financial Centre (NIFC) Bill, and the Alternative Dispute Resolution (ADR) Regulatory Commission Bill.

The Electronic Transaction Bill, if passed into law, would give effect to the admission in evidence of all electronically generated statements of account which the Evidence Act currently forbids. The Financial Ombudsman Bill, aims to facilitate faster resolution of financial disputes, while the Alternative Dispute Resolution (ADR) Regulatory Commission Bill is proposed to create an ADR Commission to promote and regulate the practice and use of ADR in Nigeria.

The issue with problem loans has become quite defiantly frequent in the banking industry these days.  The problem does not only permeate and pervade the industry, but it has shaken the industry to its very foundation that it easily registers as one of the primary foundation causes of distress and failures in the industry. For a bank to achieve the needed success in loan recovery, it needs lawyers that are grounded not only in Banking Law Practice but also in Banking Operations including Credit Risk Management.

Wills & Intestacy:

We provided advice to our clients in matters involving contentious probate and intestacy disputes. We "warned off" caveats filed for letters of administration, conducted relevant searches at the Probate Registry, provided advice to clients on the resealing of grants of administration and prevent a deceased's estate being taken into receivership pending the grant of letters of administration.

Ben Udowa, LL.B (Hons), BL, ACIArb (London), BSc, MBA, FCTI, FCA

Ben Udowa is the founder and Chairman/CEO of the firm.  He is a multi-disciplinary expert. Specifically, Ben Udowa holds an LLB from the University of Calabar, a BL from the Nigerian Law School, called to Bar and enrolled by the Supreme Court of Nigeria (SCN) as Barrister and Solicitor of the Supreme Court. In addition, he holds a Bsc in Business Administration from the University of Lagos, and an MBA in Marketing from Rivers State University of Science and Technology, Port Harcourt. 

Ben Udowa is also a Chartered Accountant and a Chartered Tax Practitioner of over 20 years post qualification experience in multiple disciplinary skills acquired from reputable accounting and tax firms. He is a Professional Banker with years of experience at various top management positions in the top ranking banks including Chase Merchant Bank, Nigeria, United Bank for Africa Plc and Access Bank Plc. He left Access Bank Plc, an A rated bank as a General Manager/Regional Director into full time legal practice. Ben Udowa draws appropriately from multiple disciplines to redefine problems outside of normal boundaries an achieve solutions based on a novel understanding of complex situations.

Ben Udowa is a member of many professional bodies both local and international including Fellow of the Institute of Chartered Accountants of Nigeria (ICAN), Fellow of the Chartered Institute of taxation of Nigeria (CITN), Senior member of the Chartered Institute of Bankers of Nigeria (CIBN), Associate member of the Chartered Institute of Arbitration of London, Member of the Nigerian Bar Association, and Member International Bar Association.

Victoria Udowa, LL.B (Hons), BL

Victoria Udowa is the head of our Abuja Business Office. She obtained her LLB Degree from the Rivers State University of Science & Technology (UST), Port Harcourt, BL from the Nigerian Law School and called to Bar as Barrister and Solicitor of the Supreme Court.

She specializes in corporate law practice, contract and employment law. She also has extensive knowledge of Health and Safety issues. Victoria recently initiated, chaired, and successfully executed the restructuring of Straville Inc. Limited, Multi-operations Limited, and Corporate Analyst limited. Queeneth Udowa, LL.B (Hons), BL

Queeneth Udowa is the head of our Human Rights et el, desk. She obtained her LLB Degree from Sheffield University, London, BL from the Nigerian Law School and called to Bar as Barrister and Solicitor of the Supreme Court.

She specializes in Human Rights Law. She also has extensive knowledge of Industrial, Intellectual Property and Pharmaceutical Law. Queeneth has done extensive work in the area of International and relations.

 

Theodore Williams, LL.B (Hons), BL

Theodore I. S. Williams is the head of our Criminal & Taxation Law practice. He obtained LLB Degree from the University of Abuja, Abuja, FCT, BL from the Nigerian Law School and called to Bar as Barrister and Solicitor of the Supreme Court. He is grounded in criminal legal practice with over ten years practice experience acquired from reputable law firms.

Williams's practice includes all Criminal & Commercial Litigation & Arbitration, Business Advisory Services, Foreign Investment & Taxation, Oil & Gas, and Business Regulatory. He has handled cases in state and federal courts throughout the country, and participated in arbitrations both nationally and internationally.

In addition to his litigation practice, Williams works with clients to negotiate and prepare contracts, subcontracts, and requests for proposal. He is a member of many professional bodies within and outside the country.

 

 

Olawale Oshunde, LL.B (Hons), BL 

Olawale Oshunde is our head of our Oil & Gas and Environmental Law Team. Olawale obtained his LLB from Olabisi Onabanjo University, Ago-Iwoye, BL from the Nigerian Law School and called to Bar as a Barrister and Solicitor of the Supreme Court.

Olawale Oshunde specializes in Oil & Gas Law and in Environmental Law. He has done extensive work on topical issues in the Oil & Gas Industry and on Environmental impact assessment, protection and pollution control.

He is a member of various National and International Associations to include Nigerian Bar Association, American Communication Association, International society for development and sustainability, Associate member of the Institute of Strategic management, Nigeria, Associate Member of the Institute of Corporate and Business Affairs management, Nigeria etc.

 

Ufuo Asanwana, LL.B (Hons), BL 

Ufuo Asanwana heads our Debt Recovery Team with oversight function on our Eket Business Office. Asanwana obtained his LLB from University of Calabar, Cross River State, BL from the Nigerian Law School and called to Bar as a Barrister and Solicitor of the Supreme Court.

Ufuo Asanwana specializes in Property Practice & Realty, Debt Recovery, Legal Drafting, Copyright and Patent, and General Litigation. He worked extensively with the Asset Management Corporation of Nigeria (AMCON) on debt recovery, reconstruction, and restructuring.

He is a member of various National and International Associations to include Nigerian Bar Association, American Communication Association
